Abstract

The article is devoted to the conflict of laws problem, which appears when using standards providing juridical guarantees and legal restraints in the field of employment of women, who want to serve in the National Police of Ukraine. With reference to provisions of active law concerning legal norms and normative acts about service in the National Police of Ukraine, the problem of conflict between juridical guarantees and legal restraints in the field of employment of women, who are applicants to the National Police is researched. The author has proposals concerning improvement of legislation, which regulates the procedure of women employment, and prospects of its further development. The author indicates that establishment of an employment relationship with the applicants to the National Police, both with men and women, begins from the moment they are taken on the staff to specific branch of the National Police. But the process of employment of women, who apply to the National Police has its peculiarities and is connected both with specific nature of professional activity in police service (taking into consideration the peculiarities of the future profession) and biophysical and physiological peculiarities of woman’s organism (taking into consideration sex of an applicant). According to the research the conclusion can be made, that the process of employment of women, who apply to the National Police requires, firstly, providing additional juridical guarantees and, secondly, using of certain restraints because of biophysical and physiological peculiarities of woman’s organism and specific nature of the service in the National Police of Ukraine. In fact, contradiction of norms, which have at the same time juridical guarantees and legal restraints, requires jurisdictional improvement and offset of imbalances in order to eliminate the conflict of laws.
