Abstract

The article explores implementation problems of the implementation and effectiveness of socio-economic guarantees provided to employees of enterprises with the status of internally displaced persons. The author substantiates and analyzes the effectiveness of benefits and benefits granted under the current legislation to employees who have the status of internally displaced persons in the emergence, change and termination of employment and social and legal relations. The tasks were solved by using such methods as the analysis and generalization of scientific, popular science literature and regulations that provide benefits and benefits to employees of enterprises with the status of internally displaced persons. The author proposes to make certain changes and additions to the current legislation, which regulates legal relations in the field of providing socio-economic guarantees for employees of enterprises having the status of internally displaced persons. Namely, to supplement Art. 42 of the Labor Code "Prevailing Right to Leave at Work in the Release of Workers Due to Changes in the Organization of Production and Labor", paragraph 10, which would stipulate that, under equal conditions of labor productivity and qualification, preference is given to employees from among internally displaced persons. Add Art. 42-1 Labor Code part two of the following content: "An employee who has been forced to leave the workplace as a result or in order to avoid the negative consequences of an armed conflict or anthropogenic nature and has the status of an internally displaced person, has the pre-emptive right to conclude an employment contract in the event of a return contract work to restore control over the territory of such an employee's place of work in Ukraine".
